CONDITIONS OF BUSINESS FOR UKNEXTDAY LTD

Definitions:

"Company" means UKNEXTDAY LTD

"Booking" means a booking for the carriage of a Consignment placed by a Customer with the Carrier

"Booking Form" means the form from the Website and completed by the Customer

"Carrier(s)" means registered Couriers appointed by the Company

"Customer(s)" means the person(s) who contract for the courier services of the Carrier.

"Consignee" means the person to whom the Carrier delivers the Consignment.

"Consignment" means goods or property, whether or not contained in separate parcels, packages, containers or envelopes including any paper, documents and cash, but excluding Dangerous Goods to be delivered by the Carrier for the Customer to the Consignee.

"Dangerous Goods" means "dangerous goods" as defined in the Carriage of Dangerous Goods by Road Regulations 1996 (as amended, re-enacted or extended from time to time), and any other substance likely to cause or encourage disease, vermin, pests or other hazard.

"Website" means www.sameday-courier-network .co.uk

  1. The Company has produced the Website for the sole purpose of introducing Customers to the Carrier for the courier service that the Customer requires and the courier service that the Carrier can give. The information provided on the WebSite has not been written to meet specific Customers' requirements and it is the sole responsibility of the Customer to satisfy itself that the courier service ordered via an on-line Booking with the Carrier will be suitable for its requirements. The courier service offered by the Carriers does not extend to Dangerous Goods.
  2. The Company will endeavour without delay to transfer electronically the courier service requirements of the Customer to Carriers situated near to the collection postcode stated on the Booking Form but the Company reserves the right to decline any request from a Customer. Time shall not be of the essence of the contract and the Company shall not be liable to the Customer for any delay on its part. The Company is not responsible for any errors made by the Customer on the Booking Form. The Company will not change alter or interfere whatsoever with the contents of the Booking Form.
  3. The Company accepts no liability whatsoever for any contracts or representations made between the Customer and Carrier and has no involvement whatsoever with any correspondence or agreements whether verbal or written between them.
  4. The Company will ensure that the Carriers have at all relevant times "Goods in Transit" and Third Party liability insurance
  5. Whilst the Company makes all reasonable attempts to exclude viruses from the WebSite, it cannot ensure that the WebSite will be virus-free and the Company will not be responsible for any losses or expenses of the Customer so incurred. The WebSite is intended for use only by the residents in the United Kingdom and only in respect of their courier service requirements within the United Kingdom
  6. Any notice or other communication to be given under or in connection with this Agreement, shall be given in writing and sent by first-class post, email or facsimile to the address registered for each party, or such other address as either party may substitute by written notice to the other. A notice shall be deemed delivered within two working days of posting, in the case of first-class post; 24 hours after sending an email; and on completion of the transmission in the transmission report, in the case of facsimile.
  7.  A person who is not a party to the contract has no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of these Conditions, but this does not affect any right or remedy of a third party which exists or is available apart from that Act.
  8. These Conditions shall be subject to and construed in accordance with English law, and the parties submit to the exclusive jurisdiction of the English courts. If any provision of these Conditions is held by any court or competent authority to be invalid or unenforceable in whole or in part, the validity of the remainder of these Conditions and of such provision shall continue in full force and effect.
